Trésors du Souk General Terms and Conditions of Sale
The products offered for sale on the Site are intended for non-professional buyers and include natural cosmetics, essential oils, and various oriental products.
These General Terms and Conditions of Sale (hereinafter the “GTC”) describe the terms and conditions for the distance sale of products offered on the Site (“the Products”) between the Sellers and non-professional buyers (“the Customers” or “the Customer”), through the website www.tresorsdusouk.com and define the obligations and rights of the parties in this respect.
By placing an order on the website www.tresorsdusouk.com, the Customer agrees to and fully accepts these GTC, which the Customer expressly acknowledges, waiving, in particular, the right to invoke any contradictory document that would therefore be unenforceable against the company Altinova Solutions.
These GTC are accessible at any time on the Site and shall prevail, where applicable, over any other version or any other contradictory document. As these GTC may be subject to subsequent amendments, the version applicable to the Customer’s purchase is the version in force on the Site on the date the order is placed.
Article 1 – Scope
These GTC apply, without restriction or reservation, to all distance sales concluded by the Seller with Customers wishing to purchase the Products offered for sale on the Site accessible at the web address: www.tresorsdusouk.com.
The Customers are consumers, defined as natural persons acting for private purposes and therefore not acting within the scope of a commercial, industrial, craft, professional or agricultural activity. The products offered include essential oils, natural cosmetics and various oriental products.
These GTC are accessible at any time on the Site and shall prevail over any other document. The Customer declares that they have read and accepted these GTC by ticking the box provided for this purpose before initiating the Site’s online ordering procedure. Any order validation entails de facto acceptance of these terms (see Article 3 – Orders).
Unless proven otherwise, the data recorded in the Seller’s computer system shall constitute proof of all transactions concluded with the Customer. For reasons of processing speed, Trésors du Souk communicates primarily and systematically by email.
Article 2 – Prices
The products are supplied at the prices in force shown on the Site when the order is recorded by the Seller. Prices are expressed in Euros, including all taxes. The prices take into account any reductions that may be granted by the Seller on the Site.
These prices are firm and non-revisable during their period of validity, but the Seller reserves the right to modify them at any time outside that period of validity.
The prices do not include processing, dispatch, transport and delivery costs, which are invoiced in addition under the conditions indicated on the Site and calculated prior to placing the order. The payment requested from the Customer corresponds to the total purchase amount, including these costs.
Article 3 – Product Characteristics – Orders
The products offered for sale on the Site are described in a manner enabling the Customer to know their main characteristics, including the products’ specifications, illustrations, and indications of dimensions or capacity, as well as their price. The Customer must review this information before placing any order. The choice and purchase of a product are the sole responsibility of the Customer.
Pre-contractual and contractual information is presented in French and is confirmed no later than when the Customer validates the order.
Product offers are valid while they are visible on the Site, subject to availability. The Customer is responsible for selecting on the Site the products they wish to order, according to the following procedure:
- The Customer selects the quantity of products and then clicks the “I Buy” button;
- The floating cart opens and the Customer may continue shopping or click the “Cart” button if they wish to finalize their current order;
- The Customer may benefit from any applicable discount vouchers by entering their references in the field provided for this purpose;
- The Customer selects their delivery and billing address, then selects the transport method and makes payment to confirm the order.
Article 4 – Customer Area – Account
To place an order, the Customer is invited to create an account (personal area). To do so, they must register by completing the form provided at the time of their order and undertake to provide truthful and accurate information concerning their civil status and contact details, including their email address, telephone number (if provided), and the various delivery and billing addresses.
The Customer may log in to their personal area using their login details and password. This personal area enables them to track their orders, manage their personal information and monitor their loyalty program.
Article 5 – Payment Terms
The price is paid through a secure payment method, by bank card or via PayPal. Payment data is exchanged in encrypted form using the protocol defined by the approved payment service provider handling the banking transactions carried out on the Site. Payments made by the Customer shall be considered final only after the Seller has effectively collected the amounts due.
Article 6 – Delivery
Products ordered by the Customer shall be delivered within 48h to 72h to the address indicated by the Customer when placing their order on the Site, except in cases of force majeure. The Seller undertakes to use its best efforts to deliver the products ordered by the Customer within the specified time limits.
The Customer must verify the condition of the delivered products. They have 14 days from delivery to submit complaints by email, accompanied by all relevant supporting documents (including photographs). The Customer is responsible for checking the goods received upon delivery. Any complaint, reservation and/or dispute relating to apparent defects and lack of conformity must be made within 2 (TWO) days following delivery. In the event of proven apparent defects or lack of conformity, the defective or non-conforming products shall be replaced (subject to verification; see Article 9). A warranty refund may not be requested in circumstances involving use and/or performance not provided for (see Article 9).
Article 7 – Right of Withdrawal
The Customer has fourteen (14) days to exercise their right of withdrawal from a distance contract, without having to provide reasons for their decision. Products must be returned in their original and complete condition (packaging, accessories, instructions, etc.). Damaged, soiled or incomplete products will not be accepted for return.
Article 8 – Seller’s Warranties and Liability
To assert their rights, the Customer must inform the Seller in writing (by email) of the lack of conformity of the Products or the existence of hidden defects as soon as they are discovered. The Seller shall refund, replace or repair the Products or parts covered by warranties that are deemed non-conforming or defective. Shipping costs shall be reimbursed on the basis of the amount invoiced, and return costs shall be reimbursed upon presentation of supporting documents. Refunds, replacements or repairs of Products deemed non-conforming or defective shall be carried out as soon as possible and no later than 30 days following the Seller’s finding of the lack of conformity or hidden defect. This refund may be made by bank transfer or bank cheque.
The Seller’s liability shall not be incurred in the following cases:
- Failure to comply with the legislation of the country in which the products are delivered, which the Customer is responsible for verifying,
- In the event of improper use, use for professional purposes, negligence or lack of maintenance by the Customer, as well as in the event of normal wear and tear of the Product, an accident or force majeure.
- The photographs and graphics presented on the Site are not contractual and shall not incur the Seller’s liability.
In any event, the company declines all liability, particularly regarding the Customer’s choice of products and, above all, any modifications that may have been made to them or improper use contrary to the products’ instructions for use.
Furthermore, the company is designated as the Seller and, in this capacity, is not the producer, within the meaning of Articles 1245 et seq. of the Civil Code, of the products marketed on the Site. Consequently, its liability cannot and shall not be incurred for damage caused to property and/or persons due to a defect in the products within the meaning of the aforementioned articles. A Customer wishing to obtain compensation for such damage must therefore contact the supplier and/or manufacturer concerned and seek to establish the latter’s liability. In any event, the Seller’s warranty is limited to replacing or refunding Products that are non-conforming or affected by a defect.
